- I think the ideologies among the justices within the Supreme Court at the time of major cases associated with US territories affected decisions just as much as ideologies affect decisions within the Supreme Court today. Obviously, from the material we’ve examined during this class there were clear white supremacist beliefs among a lot of these individuals deciding law and justice. Especially, as these justices are elected for life, and they can act on whichever ideologies they choose (within the bounds of the law) they are not necessarily any longer highly motivated to make decisions based on more strict interpretations of the constitution and law. They can “loosen” their interpretations to make decisions more in line with corporate interests for example. So, it comes as no surprise that based on the circles they were most likely involved with at the time laws were crafted for U.S. territories that they followed that frame of thought and made decisions based on who they were in bed with.
